Still not getting it...

The government (EPA) tests the vehicle and publishes an estimated fuel usage number.

Good or bad, the car company puts this number in their literature (sticker, brochures, websites, etc).

A consumer apparently doesn't get the MPG stated in the literature and sues.

Why do so many people think car companies come up with the MPG numbers on their own?

this case will be thrown out in no time. just some guy looking for a buck... probably a gm employee
I'm not so sure about that. There was a woman who took Honda to Small Claims court over the Civic Hybrid EPA MPG estimate and won in CA. Luckily, Honda won the appeal (because Honda doesn't get to make that number up... the EPA tested the car to come up with those numbers, so Honda is within their right to use it in promotional literature).

It's a crazy world we live in. People will sue for anything now-a-days. What's worse is when they actually win and set a precedence.
