Saw Someone Is Starting A Class Action Against Lexus (Toyota) Based On Mileage Claims

So I Googled this story. Some Lexus CT200h owner is suing Toyota claiming that his CT200h's mileage claims are way over exaggerated. I'm not sure how he's driving his CT but Lexus claims about 42 combined. I have yet to get that low a figure. The mileage figure on the current display in the car is exactly 3 MPG over when I actually compare with miles driven vs gas added to fill the tank up. I use Fuelly.com and have since I owned my car and have never got less than 46 MPG and that was recently when I got the recall fixed (they probably left my car running).

I use the Gas Cubby app on my iPhone, and my true accurate average mileage since I bought my car is 5.8 l/100km
what are the chances the guy will win? nearly none? I usually get 42 but I've also gotten 40 and 39 depending on how I drive. I think the EPA is 42, 41

maybe the guy is really big and carries a lot of people in his car and gets 35 mpg lol

Anyone can launch a law suit, but what matters is whether he can prevail in his complaint. I am averaging 46.5 mpg here in Northern NJ back roads, my average speed is about 37 mph. I did notice mileage drop when I purposely under inflated my rear tire by one psig, i.e. from 32 to 31. That was my attempt to soften the bouncy rear end. I think the solution is to instal F-Sport anti sway bar. But the mileage went right up when I return to specified inflation.
Check out fuelly stats. 132 CT and the average is 42-43 mpg, right on the money.

I get 45 to 47 mpg normally, the most I have gotten is 51mpg on a 50 mile trip. I drove 55 mph and avoided he power zone as much as possible. Has anyone tried driving past empty? The furthest I have gone is a 9.0 gal fillup.

to be honest, most car companies "claim" that their car can achieve amazing fuel economy in their brochures.

honda insight advertise their car to be able to do 21km/l

lets be honest, the only way the insight will be able to do that sort of figure would be if the driver is constantly hyper-mile-ing. In Malaysia, the CT 200h brochure claims that our car can do 31km/l. i am averaging 19km/l. and most of us are doing around 19km /l.

i usually take the "claim" fuel consumption plus a 30% for a hybrid (and NA cars) and plus 40% for a turbo.

Well, I can't get more than an average of 39 out of my CT. Its tends to go up and down from 38.2 to 40.0. These are the tank averages. I'm only on my 3rd tank. My overall is still reading in the 36 range. I've never seen a car that gets as much as their rating claims.

There's just no telling with those Chinese made engines.
I'm averaging 51.2 on mostly highway driving, 49.4 in pure city driving. Way above claims. MPG is all about driving style. I could make it average 35mpg if I spent all day booting it to the floor and then slamming on the brakes.

I agree it is just driving smarter. Since I got the CT I pay more attention to lights changing not rocketing off at starts. Just driving normally no hyper mailing I am getting above the stated 42 MPG. Wonder if the person sueing is in CA. California seems to be sue happy onver anything.

It just could be "the nut that's holding the wheel" !!! Unless he's having some weird mechanical problem, or driving like he's being chased by the cops...there's absolutely isn't any reason not to average at least per the manufacture MPG. I'm getting a true 49 mpg, and that's even after playing with it in the "sport" mode from time-to time.

The government (EPA) tests the vehicle and publishes an estimated fuel usage number.

Good or bad, the car company puts this number in their literature (sticker, brochures, websites, etc).

A consumer apparently doesn't get the MPG stated in the literature and sues.

Why do so many people think car companies come up with the MPG numbers on their own?

The way car companies test for fuel economy is different from real city driving anyways. They test in a circle and only flat land, while we have hills and bumpier roads etc. I had an Insight before i bought the CT and my average for that vehicle was 5.7-6L/100km. When the company claimed it was 5L/100km. My CT now is at 4.8L/100km but my car is only 3 weeks old and i'm still babying it to run it in. So prob once that is over, and with my heavier foot it'll be over 5L/100km. Which in my opinion is still really good compared to what gas prices are at now.

I don't think the guy will win his law suit because if he actually read the print about fuel economy every print clearly says "Estimated fuel economy is ___ " so , good luck to him!

I'm not so sure about that. There was a woman who took Honda to Small Claims court over the Civic Hybrid EPA MPG estimate and won in CA. Luckily, Honda won the appeal (because Honda doesn't get to make that number up... the EPA tested the car to come up with those numbers, so Honda is within their right to use it in promotional literature).

It's a crazy world we live in. People will sue for anything now-a-days. What's worse is when they actually win and set a precedence.
"Your mileage may vary" is correct. After 15,000miles, my worst tank was 52 MPG (per computer), the best 59 MPG.
